上證報中國(guo)證券網訊 據國(guo)家(jia)發(fa)展(zhan)改(gai)革(ge)委7月6日消息,為進一步加強(qiang)基礎設施建設項(xiang)目(mu)管理(li),堅持質量(liang)第一,保(bao)障人(ren)民群眾生命財(cai)產安(an)全,國(guo)家(jia)發(fa)展(zhan)改(gai)革(ge)委近日印發(fa)《關于加強(qiang)基礎設施建設項(xiang)目(mu)管理(li) 確保(bao)工程安(an)全質量(liang)的通(tong)知(zhi)》,要(yao)求嚴(yan)把超高(gao)層建筑審查(cha)關,不得(de)新建500米以(yi)上超高(gao)層建筑。

各省、自治區、直(zhi)轄市(shi)(shi)及計(ji)劃單列市(shi)(shi)、新疆生產建設兵團發展(zhan)改革委:
??近年(nian)來(lai),各地方(fang)不斷(duan)加強基(ji)礎(chu)設(she)施(shi)等領域建設(she)項(xiang)目(mu)管理(li)(li),工程安(an)(an)全質(zhi)(zhi)量水平不斷(duan)提高(gao)。但仍有一些項(xiang)目(mu)管理(li)(li)不嚴,相關管理(li)(li)規定落實不到(dao)位,造成工程質(zhi)(zhi)量下(xia)降(jiang)、安(an)(an)全隱患增加。為進一步加強基(ji)礎(chu)設(she)施(shi)建設(she)項(xiang)目(mu)管理(li)(li),堅持質(zhi)(zhi)量第(di)一,保(bao)障人(ren)民群(qun)眾(zhong)生命財產安(an)(an)全,現就(jiu)有關事項(xiang)通知如下(xia):
??一、加強項目審核(he)把關
??(一)規(gui)范履(lv)行(xing)項(xiang)目(mu)(mu)(mu)審批(核(he)準(zhun)、備案)程序。嚴格按(an)照《政(zheng)府(fu)投資(zi)條(tiao)例(li)》《企(qi)業投資(zi)項(xiang)目(mu)(mu)(mu)核(he)準(zhun)和備案管(guan)理條(tiao)例(li)》等(deng)有關(guan)(guan)規(gui)定(ding),履(lv)行(xing)投資(zi)項(xiang)目(mu)(mu)(mu)審批(核(he)準(zhun)、備案)程序。政(zheng)府(fu)投資(zi)項(xiang)目(mu)(mu)(mu)要按(an)照國家(jia)有關(guan)(guan)規(gui)定(ding)報(bao)批項(xiang)目(mu)(mu)(mu)建(jian)(jian)議書(shu)、可行(xing)性研究(jiu)報(bao)告(gao)、初步設(she)計。企(qi)業投資(zi)項(xiang)目(mu)(mu)(mu)要根據《政(zheng)府(fu)核(he)準(zhun)的(de)投資(zi)項(xiang)目(mu)(mu)(mu)目(mu)(mu)(mu)錄》等(deng)有關(guan)(guan)規(gui)定(ding),履(lv)行(xing)核(he)準(zhun)或備案手(shou)續。未按(an)規(gui)定(ding)履(lv)行(xing)審批(核(he)準(zhun)、備案)程序、不(bu)符合規(gui)定(ding)的(de)建(jian)(jian)設(she)條(tiao)件的(de)項(xiang)目(mu)(mu)(mu),不(bu)得開工建(jian)(jian)設(she)。
??(二)在前期工作階段(duan)進一步(bu)加強(qiang)工程質(zhi)量管(guan)理。項(xiang)(xiang)目(mu)單(dan)位應(ying)(ying)當(dang)提(ti)(ti)高項(xiang)(xiang)目(mu)前期工作質(zhi)量,確(que)保項(xiang)(xiang)目(mu)建議書(shu)、可(ke)行(xing)性(xing)研(yan)究報告、初步(bu)設計(ji)、項(xiang)(xiang)目(mu)申請(qing)報告等(deng)文件的(de)深(shen)度達到規定的(de)要求。規劃選(xuan)址階段(duan)要優(you)化工程選(xuan)址方案,盡量避(bi)免(mian)風險較大的(de)敏感區域。可(ke)行(xing)性(xing)研(yan)究報告要對涉及工程安全(quan)質(zhi)量的(de)重(zhong)大問題進行(xing)深(shen)入分析、評價(jia),提(ti)(ti)出應(ying)(ying)對方案。初步(bu)設計(ji)要嚴格執行(xing)工程建設強(qiang)制(zhi)性(xing)標準,提(ti)(ti)出安全(quan)質(zhi)量防護措施,并對施工方案提(ti)(ti)出相應(ying)(ying)要求。
??(三)嚴(yan)把超(chao)高(gao)層(ceng)建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)審(shen)查(cha)關。嚴(yan)格執(zhi)行(xing)(xing)《住(zhu)房和(he)城(cheng)鄉建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)設部(bu)、國家發展改革委關于進一步加強城(cheng)市與建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)風貌(mao)管(guan)理的(de)通(tong)知》,把超(chao)大體(ti)量公(gong)眾(zhong)建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)、超(chao)高(gao)層(ceng)建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)和(he)重(zhong)點地段建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)作為城(cheng)市重(zhong)大建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)項目進行(xing)(xing)管(guan)理。其中,對100米以(yi)上(shang)建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)應嚴(yan)格執(zhi)行(xing)(xing)超(chao)限高(gao)層(ceng)建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)工程(cheng)抗震設防(fang)(fang)審(shen)批(pi)制度,與城(cheng)市規(gui)模(mo)、空間尺度相(xiang)適宜(yi),與消(xiao)防(fang)(fang)救(jiu)援能力相(xiang)匹(pi)配;嚴(yan)格限制新建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)250米以(yi)上(shang)建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu),確(que)需建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)設的(de),要結合消(xiao)防(fang)(fang)等專題論證進行(xing)(xing)建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)方(fang)案審(shen)查(cha),并報住(zhu)房城(cheng)鄉建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)設部(bu)備案;不得新建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)500米以(yi)上(shang)超(chao)高(gao)層(ceng)建(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)筑(zhu)。
??(四)落實項目(mu)決(jue)策咨詢評(ping)估制度。項目(mu)審(shen)(shen)批(pi)(pi)(核準)部(bu)門在審(shen)(shen)批(pi)(pi)(核準)項目(mu)時按照有關規定(ding)應委(wei)托(tuo)咨詢評(ping)估的(de),必須先完(wan)成委(wei)托(tuo)咨詢評(ping)估程序(xu),再(zai)作出審(shen)(shen)批(pi)(pi)(核準)決(jue)定(ding)。評(ping)估機構要加強對(dui)工程安全質量(liang)的(de)評(ping)估,對(dui)出具的(de)評(ping)估論證(zheng)意見承(cheng)擔責任,投資主管(guan)部(bu)門要加強評(ping)估質量(liang)評(ping)價管(guan)理。
??二、嚴格執行項目(mu)管(guan)理制度(du)和程(cheng)序(xu)
??(一)嚴格落(luo)(luo)實(shi)“項(xiang)(xiang)目(mu)四制(zhi)”。落(luo)(luo)實(shi)項(xiang)(xiang)目(mu)法人責(ze)任(ren)制(zhi),項(xiang)(xiang)目(mu)單位(wei)(wei)和(he)(he)(he)法定代表(biao)人對(dui)項(xiang)(xiang)目(mu)建設(she)的(de)(de)安全(quan)質(zhi)量(liang)(liang)負總責(ze)。落(luo)(luo)實(shi)招(zhao)標(biao)投(tou)(tou)標(biao)制(zhi),按(an)照《招(zhao)標(biao)投(tou)(tou)標(biao)法》《必須招(zhao)標(biao)的(de)(de)工(gong)(gong)程項(xiang)(xiang)目(mu)規定》《必須招(zhao)標(biao)的(de)(de)基礎設(she)施和(he)(he)(he)公用事業項(xiang)(xiang)目(mu)范圍規定》等要(yao)求做好項(xiang)(xiang)目(mu)招(zhao)投(tou)(tou)標(biao)工(gong)(gong)作,并(bing)將強制(zhi)性安全(quan)質(zhi)量(liang)(liang)標(biao)準(zhun)等作為招(zhao)標(biao)文(wen)件的(de)(de)實(shi)質(zhi)性要(yao)求和(he)(he)(he)條件。落(luo)(luo)實(shi)工(gong)(gong)程監理制(zhi),監理單位(wei)(wei)要(yao)認真履行監理職責(ze),特別要(yao)加強對(dui)關鍵工(gong)(gong)序(xu)、重(zhong)要(yao)部位(wei)(wei)和(he)(he)(he)隱蔽工(gong)(gong)程的(de)(de)監督檢(jian)查。落(luo)(luo)實(shi)合同管理制(zhi),建設(she)工(gong)(gong)程的(de)(de)勘(kan)察設(she)計、施工(gong)(gong)、設(she)備材料采購和(he)(he)(he)工(gong)(gong)程監理等要(yao)依(yi)法訂(ding)立合同,并(bing)明確(que)安全(quan)質(zhi)量(liang)(liang)要(yao)求以及違約(yue)責(ze)任(ren)等。
??(二)科(ke)學(xue)(xue)確(que)定(ding)并(bing)嚴格(ge)(ge)執行(xing)合(he)理建(jian)設(she)(she)工(gong)(gong)(gong)期。按照國家(jia)有(you)關規定(ding),在充分(fen)評估論證的基礎(chu)上科(ke)學(xue)(xue)確(que)定(ding)合(he)理建(jian)設(she)(she)工(gong)(gong)(gong)期,防止邊勘察、邊設(she)(she)計、邊施工(gong)(gong)(gong)。嚴格(ge)(ge)執行(xing)建(jian)設(she)(she)工(gong)(gong)(gong)期,任何單位和個(ge)人不(bu)得非法干(gan)預、任意壓縮合(he)理工(gong)(gong)(gong)期。確(que)需(xu)調整工(gong)(gong)(gong)期的,必須經過充分(fen)論證,并(bing)采取(qu)相應措施,通過優化(hua)施工(gong)(gong)(gong)組織等,確(que)保工(gong)(gong)(gong)程安(an)全質量。
??(三)嚴格工(gong)程造(zao)價(jia)和建(jian)設資(zi)(zi)(zi)金(jin)管理。項目招(zhao)標投標確(que)定的(de)中標價(jia)格要體現合(he)理造(zao)價(jia)要求,杜絕造(zao)價(jia)過低(di)帶來(lai)的(de)安全(quan)質量問題。政府投資(zi)(zi)(zi)項目所需資(zi)(zi)(zi)金(jin)應當按照(zhao)國家有關規(gui)(gui)定確(que)保(bao)落實到位,不(bu)得由施工(gong)單位墊(dian)資(zi)(zi)(zi)建(jian)設,不(bu)得隨意縮減政府投資(zi)(zi)(zi)計劃明確(que)的(de)投資(zi)(zi)(zi)規(gui)(gui)模。嚴禁轉移、侵占、挪用(yong)政府投資(zi)(zi)(zi)資(zi)(zi)(zi)金(jin)。
??(四)嚴格組(zu)織(zhi)項目竣(jun)工(gong)(gong)(gong)驗收(shou)(shou)(shou)。項目建(jian)成后,應當(dang)按(an)照國(guo)家有關(guan)規(gui)定組(zu)織(zhi)竣(jun)工(gong)(gong)(gong)驗收(shou)(shou)(shou),將工(gong)(gong)(gong)程(cheng)質量作(zuo)為(wei)竣(jun)工(gong)(gong)(gong)驗收(shou)(shou)(shou)的(de)重要(yao)(yao)內容。工(gong)(gong)(gong)程(cheng)質量達(da)到(dao)規(gui)定要(yao)(yao)求(qiu)的(de),方可通過竣(jun)工(gong)(gong)(gong)驗收(shou)(shou)(shou);工(gong)(gong)(gong)程(cheng)質量未達(da)到(dao)要(yao)(yao)求(qiu)的(de)要(yao)(yao)及時整改,直至符合工(gong)(gong)(gong)程(cheng)質量相關(guan)驗收(shou)(shou)(shou)標準后,方可交(jiao)付(fu)使用。
??(五)嚴格做好(hao)(hao)項目(mu)(mu)檔(dang)案工(gong)(gong)作。督促項目(mu)(mu)單(dan)位(wei)按照國家有關規(gui)定加強項目(mu)(mu)檔(dang)案管理(li),做好(hao)(hao)項目(mu)(mu)審批、實(shi)施、竣工(gong)(gong)驗收等各環節有關文件資料(liao)的收集、整理(li)、歸(gui)檔(dang)、移交等工(gong)(gong)作,確保資料(liao)無缺失遺(yi)漏(lou)。
??三、加強項目實施事中事后監管
??(一)加強投(tou)資(zi)(zi)法(fa)規執法(fa)。強化《政府投(tou)資(zi)(zi)條例》《企業投(tou)資(zi)(zi)項(xiang)目(mu)(mu)核(he)準和備(bei)案管理條例》制度執行,加強對本地(di)區投(tou)資(zi)(zi)項(xiang)目(mu)(mu)特別(bie)是(shi)備(bei)案類項(xiang)目(mu)(mu)的事(shi)(shi)中事(shi)(shi)后監管,將(jiang)項(xiang)目(mu)(mu)是(shi)否按照審批(pi)(核(he)準、備(bei)案)的項(xiang)目(mu)(mu)建(jian)(jian)設(she)地(di)點、建(jian)(jian)設(she)規模(mo)、建(jian)(jian)設(she)內容(rong)等進(jin)行建(jian)(jian)設(she)作為(wei)核(he)查重點。
??(二)加強(qiang)中(zhong)(zhong)央預(yu)算內投(tou)(tou)(tou)資(zi)項(xiang)目監(jian)(jian)管(guan)(guan)。中(zhong)(zhong)央預(yu)算內投(tou)(tou)(tou)資(zi)項(xiang)目的(de)日常監(jian)(jian)管(guan)(guan)直接責任單位對項(xiang)目單位開展定(ding)期或不定(ding)期檢查,日常監(jian)(jian)管(guan)(guan)直接責任單位中(zhong)(zhong)的(de)監(jian)(jian)管(guan)(guan)責任人“三到(dao)現(xian)場”,以及各級(ji)發展改(gai)(gai)革(ge)部門組織開展中(zhong)(zhong)央預(yu)算內投(tou)(tou)(tou)資(zi)項(xiang)目事中(zhong)(zhong)事后監(jian)(jian)管(guan)(guan),均(jun)要將工(gong)程安全(quan)質(zhi)量作為重要監(jian)(jian)管(guan)(guan)內容,對于發現(xian)的(de)工(gong)程安全(quan)質(zhi)量問題要及時(shi)整改(gai)(gai)到(dao)位。地方(fang)安排(pai)的(de)政府投(tou)(tou)(tou)資(zi)也要參照(zhao)上述要求加強(qiang)工(gong)程安全(quan)質(zhi)量監(jian)(jian)管(guan)(guan)。
??(三(san))發(fa)揮(hui)審計(ji)(ji)、督(du)(du)查(cha)(cha)等(deng)監督(du)(du)作用。積極配合關(guan)于基礎(chu)設施(shi)建設項目和政府投資管理的(de)審計(ji)(ji)、督(du)(du)查(cha)(cha)等(deng)。對發(fa)現的(de)工程安全質(zhi)量等(deng)問題,要(yao)督(du)(du)促(cu)有關(guan)地方和單位限期進行整改(gai)。
??(四)加強(qiang)社會(hui)(hui)監(jian)督(du)。按照有(you)關規定(ding)做好基(ji)礎設施(shi)建設項目(mu)信(xin)息公(gong)開(kai)和施(shi)工(gong)現場公(gong)示,積(ji)極接受社會(hui)(hui)監(jian)督(du)。對(dui)有(you)關單位(wei)、個人和新(xin)聞(wen)媒體反映的工(gong)程安全(quan)質量問題,要按規定(ding)認真(zhen)核查處理。
??四(si)、強化(hua)工程安全質量問(wen)題懲戒問(wen)責
??(一)加強安全(quan)質(zhi)量事(shi)故懲戒(jie)問責。基礎設施(shi)(shi)建(jian)設項(xiang)目發生重大安全(quan)質(zhi)量事(shi)故的(de),要按照國家(jia)有關規定,由有關部門依法追究(jiu)項(xiang)目單位、監管責任單位和(he)勘察設計(ji)、施(shi)(shi)工、監理等(deng)單位以及相關人(ren)員的(de)法律責任。
??(二)加強中央預算內投資項目工程質量問題懲戒問責。對于工程質量存在重大問題的中央預算內投資項目,除依法追究相關單位和人員的法律責任外,各級發展改革部門還應按照《政府投資條例》《中央預算內投資補助和貼息項目管理辦法》《中央預算內直接投資項目管理辦法》等有關規定,采取通報批評、停止撥付安排中央預算內投資、在一定時期和范圍內不再受理該項目單位資金申請報告、將相關信息納入全國信用信息共享平臺實施聯合懲戒等措施,對相關單位和人員予以懲戒。

各級發展改革部門要高(gao)度(du)重(zhong)視基(ji)礎設施建設項目安全質量工(gong)作,以(yi)對人民群眾高(gao)度(du)負責的態度(du),加(jia)強組織領(ling)導(dao),加(jia)大工(gong)作力(li)度(du),層層壓實(shi)責任,切實(shi)加(jia)強基(ji)礎設施建設項目管(guan)理(li),不斷提高(gao)基(ji)礎設施工(gong)程質量,確保工(gong)程安全。
